Remote Gaming License Application

Promethean Advisory Limited’s qualified staff of lawyers and members of our licensing team, regularly assist and provide operators with the necessary consultancy in obtaining remote gaming licenses across all classes.
All operators of remote gaming in or from Malta ought to possess a valid license in relation to the pertinent class of licence required pursuant to the specific services being offered. The same application review process is undertaken for the several B2B and B2C licence process, although different documents and procedures are required depending on the type of licence being applied for.
At the application stage, the MGA assesses whether an applicant:
  • Is fit and proper to conduct gaming business.
The MGA conducts a fitness and propriety test on the applicant by assessing all information, including sources of funds and wealth, related to its shareholders, UBOs, relevant key persons, as well as the operation’s business viability. The MGA also conducts probity investigations with other national and international regulatory bodies.
  • Has a viable business strategy.
The MGA conducts a detailed analysis of the proposed business operations, their viability, funding, and an in-depth financial analysis of the applicant’s forecast financials. The applicant’s business plan is expected to have a detailed forecast of the operation, inclusive of marketing and distribution strategies and growth targets.
  • Satisfies statutory requirements and has the operational capacity needed to meet the obligations prescribed by law and policy.
The MGA conducts a review of the instruments the applicant requires to conduct the business. This process includes examining incorporation documents, the games, the business processes related to conducting the operation (the rules, terms, conditions and procedures of the games, and the application and system architecture of the gaming and control system), and the operating policies and procedures.
  • Has correctly implemented what has been applied for on a technical environment before going live.
Once the above review is successfully completed (a process which takes approximately 12-16 weeks), the MGA will inform the applicant to implement the systems onto a technical environment in preparation to going live. The applicant will be allowed 60 days to complete this operation. At any point within those 60 days the applicant may trigger a request for an external System Audit (performed by an independent 3rd party from the pre-approved list of Service Providers). The System Audit will review the staged environment against the submitted policies and procedures.
After the System Audit is conducted and the testing environment is found to be congruent with the proposed application and satisfactorily meets the MGA criteria, the applicant will be issued a Gaming Licence which is valid for 10 years.
The Licensee will then have 60 days from the date of the issuance of the Licence to “Go Live” – upon which, the applicant shall be required to effect payments of the relevant gaming tax and duly commence operations.
